1. DEFINITIONS

Product(s): products of any kind offered for sale (manufacture of travel goods, leather goods and saddlery under the Rue de Verneuil brand, manufactured by and/or for Rue de Verneuil or its potential commercial partners) through the e-commerce service on the Website. The main characteristics of the Products are presented on the Website.

Store: any Rue de Verneuil branded store, the list of which is available on the Website, and where Products may be returned and/or exchanged. Store contact details are available via the following link: https://www.ruedeverneuil.com/fr

Eligible Store: a Store located in France allowing the Customer to choose in-store delivery, selected from a limited list offered during the order process.

Force Majeure Event: as defined in Article 17.

GTC: these General Terms and Conditions of Sale applicable to any user of the Website and any Customer.

Customer: a Website user and natural person acting as a consumer, not a trader, placing an Order, who must be over 18 years old and have full legal capacity.

Customer Account: an identification account created by the Customer on the Website.

Contract: the sales contract for the purchase of Product(s) concluded between Rue de Verneuil and the Customer via the Website.

Order: the commitment to purchase one or more Product(s) selected by the Customer via the Website’s e-commerce service for personal use (or as gifts).

E-Reservation: free online reservation via the Website of one or more Products, with no obligation to purchase, to be collected in a Store.

Personal Data: any information relating to an identified or identifiable natural person (as defined by the CNIL).

Guest: a Customer placing an Order without creating a Customer Account.

Rue de Verneuil: a single-member limited liability company with share capital of €6,000, having its registered office at 1 Rue Jean-Jacques Rousseau, 75001 Paris, France, registered with the Paris Trade and Companies Register under number 532 882 370 00036.

Privacy Policy: a document explaining how Rue de Verneuil uses the personal data collected on the Website (collection, storage, processing, publication, deletion).

Customer Service: Rue de Verneuil’s customer service department, available to answer Customer inquiries by email at contact@ruedeverneuil.com, via the contact form on the “Contact Us” page of the Website, or by phone at +33 1 71 21 90 04 (local call), Monday to Friday from 10 a.m. to 6 p.m. (Paris time zone).

Website: the website published by Rue de Verneuil and accessible at https://www.ruedeverneuil.com/fr

Third Party: any natural or legal person other than the Customer or Rue de Verneuil.

2. PREAMBLE

These GTC govern the conditions under which Rue de Verneuil sells and the Customer purchases any Product on the Website.

The Customer may contact a Rue de Verneuil advisor via Customer Service for any questions regarding these GTC or, more generally, their contractual relationship with Rue de Verneuil.

These GTC apply to all Contracts, without restriction or reservation, to all Products offered for sale on the Website.

The GTC applicable are those in force on the date the Order is placed by the Customer.

The GTC prevail over any other document and apply to the exclusion of any other conditions, in particular those applicable to in-store sales, distance sales or sales through other distribution channels.

Before placing any Order, the Customer undertakes to read these GTC carefully. The Customer undertakes to retain a copy by downloading or printing them. When placing an Order, the Customer must accept the GTC and applicable prices without reservation at the time of payment. In this respect, the Customer’s click on the “Pay now” button on the Order validation page constitutes acceptance of these GTC.

The GTC must be read in conjunction with and are complementary to the Privacy Policy (available at 1 Rue Jean-Jacques Rousseau, 75001 Paris, France), which governs the collection and processing of Customers’ Personal Data, and the Cookies Policy available at the same address.

3. WARNING

3.1.

The sale of Products on the Website is exclusively reserved for retail sales to individual consumers, meaning persons acting for personal consumption needs (i.e., outside their trade, business, craft or profession and without profit-making intent).

Under no circumstances may the Website be used by professional sellers, whether acting alone or collectively, regardless of their sales method (online marketplaces, shopping galleries, intermediaries, physical stores, etc.).

The Customer acknowledges and accepts that Products may only be purchased in quantities corresponding to the average needs of a consumer, both in terms of the number of Products ordered in a single Order and the number of individual Orders placed for the same Product. Rue de Verneuil reserves the right to refuse any Order clearly placed by a professional seller.

3.2.

Each Customer declares that they are aware of the lack of reliability of the internet network, particularly in terms of relative security of data transmission, non-guaranteed continuity of access to the Website, non-guaranteed performance in terms of data volume and transmission speed, and the risk of virus propagation.

Rue de Verneuil warns each Customer of the need to implement appropriate security solutions and measures on their computer, portable or mobile device to prevent the spread of viruses.

4. CREATION OF A CUSTOMER ACCOUNT

4.1.

Any Customer may freely and free of charge create a customer account (“Customer Account”) when placing an Order on the Website via the “Create an account” section.

To do so, the Customer must complete a form and provide certain personal information, including an email address and a password, which will be used for future identification on the Website.

The Customer Account is strictly personal and allows the Customer to identify themselves before validating each Order. When creating the Customer Account, the Customer enters identification data under their sole responsibility, control and direction. The Customer chooses their login (email) and password; if the chosen login is already assigned, the system will prompt the Customer to choose another.

The login and password are personal and confidential, and the Customer undertakes not to disclose them. While Rue de Verneuil takes all reasonable precautions and undertakes to protect Customers’ Personal Data, the Customer is informed of the need to keep their password confidential and not disclose it to any Third Party for any reason.

In the event of suspected use of the login and password by a Third Party, the Customer must immediately notify Rue de Verneuil in order to change the password and/or request the closure of the Customer Account.

4.2.

In general, the Customer is informed that their Customer Account may be closed at their first request, sent by email to Rue de Verneuil.

Rue de Verneuil also reserves the right to close any Customer Account and consequently refuse any sale to a Customer in the event of non-payment of one or more previous Orders.

In such a case, Rue de Verneuil will send an email to the Customer at the address provided during account creation, informing them of the deactivation of their login and password and the closure of their account. A notice period of eight (8) calendar days is granted to the Customer to submit any observations to Rue de Verneuil, without prejudice to the suspension of the Customer Account during the notice period.

4.3.

The information provided to Rue de Verneuil when creating the Customer Account or when placing Orders must be complete, accurate and up to date. The Customer must not impersonate a Third Party or alter their age. Rue de Verneuil shall not be liable for errors made by the Customer that prevent the processing of the Order.

The Customer expressly accepts the use of email as a means of communication with Rue de Verneuil, as well as the use of electronic invoices.

In all cases, the collection of the Customer’s Personal Data in connection with the creation of a Customer Account is carried out in accordance with the Privacy Policy.

5. PRODUCT FEATURES

The Products available for sale are those displayed on the Website. Product offers are valid as long as they are visible on the Website.

Information regarding Products (including corresponding product codes) and prices is available on the Website.

The Customer may select one or more Products offered for sale on the Website, it being specified that the choice and purchase of a Product are the Customer’s sole responsibility. In accordance with Article L.111-1 of the French Consumer Code, the Customer may, prior to placing an Order, review on the Website the essential characteristics of the Product(s) they wish to order.

Products are offered subject to availability as displayed on the Website. If an Order cannot be fulfilled, in whole or in part, due to the unavailability of one or more Products after the Order has been placed, the Customer will be informed by email and the Order for the unavailable Product(s) will be automatically cancelled. Rue de Verneuil undertakes to refund any cancelled Order within the shortest possible time and no later than fourteen (14) days following the total or partial cancellation of the Order.

Rue de Verneuil reserves the right (a) to remove any Product from sale on the Website at any time, without prejudice to Orders already placed, (b) to replace or modify any information relating to any Product displayed on the Website, and/or (c) to modify a Product or any of its features or discontinue its marketing at any time and without notice, without affecting Orders already confirmed.

The characteristics of the Products sold on the Website (photographs, graphics, descriptions, etc.) are provided for indicative purposes only and may change over time. Only the visual of the Product displayed at the time of the Order should be taken into account by the Customer. The characteristics and visuals displayed on the Website are for illustration purposes only and have no contractual value. Photographs may differ slightly from reality, particularly due to the display settings of the Customer’s electronic device (computer, tablet, smartphone, etc.). Although Rue de Verneuil makes every effort to accurately present the Products, it cannot guarantee that the visuals correspond exactly to the actual appearance of the Products. In particular, fabrics, shadows, colors and textures displayed on the Customer’s screen may differ from those of the actual Product. Consequently, the Customer must rely exclusively on the Product descriptions and characteristics as stated on the Website.

In the event of errors or omissions relating to the description of a Product, Rue de Verneuil’s liability shall be limited to reimbursement of the reasonable return shipping costs incurred by the Customer.

6. ORDERING PRODUCTS

6.1.

Placing an Order on the Website is subject to compliance with the procedure implemented by Rue de Verneuil, consisting of a series of successive screens indicating the steps that the Customer must follow in order to validate their Order.

6.2.

Any Order entails an obligation to pay and requires that (a) the Customer is at least 18 years old and has full legal capacity, or (b) if the Customer is a minor, that they confirm they have obtained parental authorization to place the Order.

Rue de Verneuil shall under no circumstances be required to verify the legal capacity of any Customer. Consequently, if a natural person does not have the legal capacity to place an Order, their legal representatives (in particular parents or guardians) shall bear full responsibility for the Order and shall be required to pay the corresponding price.

6.3.

Before definitively validating the Order, the Customer will have the opportunity to review the details of the Order, its total price, and to correct any potential errors. Please note that any validated Order entails an obligation to pay.

To place and definitively validate an Order, the Customer must follow the online purchasing process and click on the “Pay now” button to submit the Order.

Payment of the Order constitutes acceptance of these GTC, the Product prices and the content of the Order.

Once the Customer has validated the Order, Rue de Verneuil will promptly acknowledge receipt by sending an Order confirmation email to the address provided by the Customer.

All Orders are subject to prior acceptance by Rue de Verneuil and are definitively confirmed only once the Customer receives an email confirming shipment of the Product(s). For this purpose, the Customer expressly agrees to the use of email by Rue de Verneuil to confirm the content of the Order. This email summarizes all information provided by the Customer, as well as prices and delivery times, and, where applicable, any difficulties or reservations relating to the Order.

6.4.

Once the Order has been placed and validated by Rue de Verneuil, and without prejudice to the foregoing, Rue de Verneuil reserves the right to cancel the Order and immediately terminate the Contract, in whole or in part, without incurring liability, for legitimate reasons, in the following cases:

(i) Rue de Verneuil is unable to obtain payment authorization from the Customer;
(ii) any Order placed by a Customer with whom there is an ongoing dispute relating to the payment of a previous Order, or any Order not compliant with these GTC; or
(iii) in the event of reported or suspected fraudulent, illegal or unauthorized activity, including Orders suspected of being placed for commercial purposes.

In such cases, Rue de Verneuil will notify the Customer by email of the cancellation of the Order and the termination of the Contract.

As sales on the Website are reserved for consumers for personal use only, and in accordance with Article L.121-11 of the French Consumer Code, Rue de Verneuil also reserves the right, in addition to the cases above, to refuse or cancel any Order for legitimate reasons where the quantity of Products ordered or the total amount payable (for one or more cumulative Orders) does not correspond to the average needs of a consumer. This includes Orders in abnormal quantities or quantities suggesting that Products are being purchased for commercial or other unauthorized or illegal purposes. Such restrictions may apply to Orders placed under the same Customer Account, using the same payment method, and/or using the same billing and/or delivery address.

6.5.

When the Order is shipped, the Customer will receive a shipment confirmation email. The Contract between the Customer and Rue de Verneuil is then deemed to be concluded.

In addition, upon delivery, the Customer will receive written confirmation for each Product of the price paid and the delivery charges applied.

Orders placed on the Website on a non-business day (Sunday or public holiday) will be processed on the next business day.

Without prejudice to the exercise of the right of withdrawal provided for in Article 12, no modification or cancellation of an Order by the Customer is possible once the Order has been confirmed. Once confirmed, the delivery address can no longer be modified.

If the Customer does not receive any email following the placement of an Order, it is their responsibility to contact Customer Service in accordance with the conditions set out in Article 14 of these GTC.

For any questions relating to Order tracking, the Customer should consult their Customer Account on the Website or contact Customer Service in accordance with Article 14 of these GTC.

Rue de Verneuil shall not be held liable in the event of an input or transmission error attributable to the Customer that prevents the delivery of the Order confirmation email and/or the Order itself.

Customers are advised to retain a copy (in electronic and/or paper format) of all information relating to their Order (for example, the Order confirmation email) and to print the confirmation email for their records.

In the event of a connection failure to the Website, the Customer’s Product selection may be lost. In such a case, the Customer will need to re-enter their selection. Products placed in the shopping cart are not reserved and may be purchased by other customers. Rue de Verneuil shall not be liable for the unavailability of a Product resulting from a Website connection failure or interruption.

Special provision – Orders placed as a Guest:

The Website allows Customers to place Orders as a Guest, without creating a Customer Account.

Under this ordering method, the Customer must provide the information necessary to process the Order. At the end of the purchase process, the Customer is invited to create a Customer Account or to continue as a non-registered guest user.

The collection of the Customer’s Personal Data in connection with a Guest Order is carried out in accordance with the Privacy Policy.

7. PRODUCT PRICES

Product prices displayed on the Website are indicated as follows:

  • French website: prices in euros (€), all taxes included;

  • International / UK website: prices in euros (€) or pounds sterling (£), excluding taxes;

  • US website: prices in US dollars ($), excluding taxes.

Prices take into account any applicable discounts at the time the Order is placed.

Any new taxes or contributions, including environmental charges, may be reflected in an increase or decrease in the sale price of Products.

Product prices do not include delivery costs (shipping, packaging and preparation of the parcel according to applicable rates), which will be added to the Product price where applicable. Such costs will be communicated during the Order process prior to Order validation and are exclusive of sales taxes or other applicable taxes.

Rue de Verneuil reserves the right to modify Product prices at any time and without prior notice. Products are invoiced on the basis of the prices in force at the time the Order is validated. The price charged is therefore the price indicated at the time of the Order.

Rue de Verneuil makes every effort to ensure that all Product prices displayed on the Website are accurate. However, errors may occur, and Products may be incorrectly priced due to a pricing error or typographical mistake. In such cases, Rue de Verneuil will cancel the Order and the Contract will be terminated.

8. PAYMENT

Any Order entails an obligation to pay by credit or debit card using a sufficiently funded bank account, or by another direct or installment-based electronic payment method (PayPal, Apple Pay).

The following cards are accepted on the Website: VISA, MASTERCARD, CARTE BLEUE and AMERICAN EXPRESS. For card payments, the Customer must be the cardholder of the card used. The Customer accesses a secure payment area provided by a banking institution, which ensures the security and recording of the payment order. In the case of card payment, the amount is debited at the time the Order is validated, subject to confirmation by the card issuer. In the event of refusal by the issuing bank, the Order will be automatically rejected.

Customers wishing to pay using their PayPal account will be redirected to the PayPal platform to log in and complete payment. The Customer will then be redirected back to the Website. In the case of PayPal payment, the debit occurs at the time the Order is validated.

Transactions carried out on the Website are processed via secure online payment platforms depending on the Website used by the Customer:

  • French website: PayPlug; Shopify Payments

  • International / UK website: Shopify Payments

  • US website: Stripe; Shopify Payments

These platforms provide highly secure pages for entering payment details (card number, cardholder name, expiry date and security code). Payment data is encrypted and transmitted to the bank in complete confidentiality and is inaccessible to third parties. Customers may choose to store their payment details in their account; in such cases, the data remains encrypted and inaccessible.

The Order becomes final only upon full payment of the price and all related fees.

The price charged to the Customer is the price indicated in the Order confirmation email sent to the Customer.

For each Order, Rue de Verneuil will issue an electronic invoice, which the Customer accepts as the invoicing method. The electronic invoice is issued based on the information provided by the Customer at the time of the Order. No modification of the electronic invoice is possible once it has been issued.

Once the Order has been shipped, the Customer is informed by email that their invoice, including delivery costs and the VAT applicable on the Order date, is available online in their Customer Account.

If payment cannot be completed for any reason, Rue de Verneuil will cancel the Order and immediately terminate the Contract without incurring liability. The Customer will be informed in writing.

Any fees charged by the card issuer, bank or other payment institution in connection with payment processing shall be borne by the Customer.

9. DELIVERY CONDITIONS

9.1.

The Customer will receive an Order number by email confirming that the Order has been properly received. The Customer will be informed by email of the various stages of Order processing.

Shipment notifications are sent to the email address provided by the Customer in their Customer Account.

A delivery note is included in the parcel, summarizing the Products ordered and actually delivered.

9.2.

The Customer is offered several delivery methods, which may be selected by the Customer.

In any event, delivery charges will be indicated to the Customer on the Website before the Customer accepts the Order and will be reiterated in the Order confirmation email sent by Rue de Verneuil, as well as on the delivery notes.

9.3.

In order for the delivery times indicated in this Article to be met, the Customer must ensure that accurate and complete information regarding the delivery address has been provided (including, but not limited to: street number, building number, staircase, access codes, names and/or intercom numbers, etc.). Inaccurate information may result in additional delivery delays or re-shipment.

Home delivery

Using the shipment tracking number, the Customer may track the progress of their parcel on the carrier’s website.

The Customer is informed that it is their responsibility to provide all information necessary for proper delivery (access codes, delivery instructions, etc.).

Upon delivery, the Customer or the recipient of the Order signs a delivery receipt. This receipt constitutes proof of delivery by Rue de Verneuil and receipt of the ordered Products by the Customer or the recipient.

If the Customer is absent at the time of home delivery, a delivery notice will inform the Customer of the parcel retention and collection conditions, which are under the sole responsibility of the carrier.

In the event of absence, the Customer or the recipient of the Order will receive a delivery notice allowing them to contact the carrier using the contact details provided in order to arrange an alternative delivery date.

Delivery to a pickup point

The Customer will be informed by email when the Order is available for collection at the selected pickup point. To collect the Order, the Customer must attend during the opening hours of the selected pickup point and present a valid form of identification together with the Order confirmation email.

If the Customer is unable to collect the Product from the pickup point, they may authorize a third party to do so. The authorized person must present a written authorization, their own identification, and the Customer’s identification. The Customer has fourteen (14) calendar days from receipt of the Order to collect it.

If the Customer refuses delivery of the parcel or fails to collect the parcel from the pickup point within the specified timeframe, delivery charges, where applicable, shall not be refunded. The Products will then be returned to Rue de Verneuil. The Customer will be refunded within fourteen (14) calendar days from receipt of the returned Products by Rue de Verneuil.

9.5. E-Reservation

Rue de Verneuil also offers Customers the option of a free in-store E-Reservation.

Products are offered subject to availability in the Boutique selected on the Website. If an E-Reservation cannot be processed, in whole or in part, due to unavailability of a reserved Product after the E-Reservation has been placed, the Customer will be informed by email and the E-Reservation for the relevant Product will be automatically cancelled.

The Customer will be informed by email of the confirmation of their E-Reservation at the selected Boutique.

To collect the Order, the Customer must attend the selected Boutique during opening hours and present a valid form of identification together with the E-Reservation confirmation email.

Payment for E-Reservation

No online payment is required.

Payment shall be made upon collection of the Order at the selected Boutique.

The reserved Product becomes the property of the Customer only once full payment has been made, using the payment methods normally accepted in Boutique.

Collection of E-Reservation

The Customer has forty-eight (48) hours from receipt of the E-Reservation confirmation email or SMS to attend the Boutique and collect the reserved Product(s).

After this forty-eight (48) hour period, the E-Reservation will be automatically cancelled and the Boutique may return the uncollected Products to sale.

Withdrawal

Customers opting for E-Reservation benefit from the same withdrawal period as that applicable to in-store purchases. As collection and payment take place in store, the sale is deemed to be concluded in the Boutique and the online reservation does not constitute a distance sale.

9.6.

Upon receipt of the Order, the Customer must verify the conformity of the Products delivered. Any delivery anomaly (including missing or damaged Products, or damaged parcels) must be noted immediately on the delivery note in the form of handwritten reservations, signed by the Customer, and reported to the carrier.

In addition, any anomaly must be reported to Customer Service within fourteen (14) days of receipt of the Products, in accordance with the procedures set out in Article 12.

Rue de Verneuil reserves the right to request the return of any non-conforming or damaged Product(s).

In the event of abnormal or abusive returns, Rue de Verneuil reserves the right to refuse future Orders.

9.7. Transfer of ownership – transfer of risks

Ownership of the Products shall be transferred to the Customer only after full payment of the price, regardless of the delivery date.

In accordance with Article L.216-2 of the French Consumer Code, the risks of loss or damage shall be transferred to the Customer only when the Customer takes physical possession of the Products at the delivery address provided or upon in-store collection.

10. DELIVERY TIMES

Rue de Verneuil undertakes to make every effort to deliver Orders as quickly as possible. The Customer may track their parcel using the tracking number provided by email at the time of shipment.

Delivery may be delayed for reasons beyond the control of Rue de Verneuil. In such cases, Rue de Verneuil undertakes to inform the Customer.

Products are delivered to the delivery address provided by the Customer at the time of the Order no later than the end of the delivery period indicated at the time of ordering, depending on the destination country.

Rue de Verneuil undertakes to ensure that delivery is made within a maximum period of thirty (30) calendar days from the date of the Order, regardless of the selected delivery method.

In the case of in-store delivery, Rue de Verneuil undertakes to ensure delivery within a maximum period of thirty (30) calendar days from the Order date.

In the event of delivery exceeding the maximum period specified above, the Customer may contact Customer Service to request that Rue de Verneuil complete delivery within a reasonable additional period. If delivery is not completed within this additional period, the Customer may terminate the Contract by email or letter and obtain a refund.

The Contract shall be deemed terminated upon receipt by Rue de Verneuil of the email or letter informing it of the Customer’s decision, unless delivery occurs between the sending and receipt of such notice.

If the Order is definitively cancelled, the Customer will receive a refund of the price paid within fourteen (14) calendar days following notification of cancellation.

Each delivery is deemed completed when the parcel is made available to the Customer, in particular by the carrier, as evidenced by the carrier’s tracking system.

If the parcel is damaged or the Product does not correspond to the Order, the Customer must initiate the return procedure described in Article 12 within fourteen (14) calendar days following shipment.

11. DELIVERY METHODS – TAXES

All shipments outside the European Union, including Switzerland and Norway, are shipped exclusive of taxes.

Any applicable taxes, including customs duties, shall be paid by the Customer upon receipt of the parcel in accordance with the laws of the destination country.

12. RIGHT OF WITHDRAWAL AND RETURNS

Pursuant to Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights and Law No. 2014-344 of 17 March 2014 as transposed into Articles L.221-18 et seq. of the French Consumer Code, any consumer has the right to cancel their Order within fourteen (14) calendar days following the date on which they received the Product(s), without giving any reason and without penalty, provided that the Product(s) are returned in their original condition, unworn and unwashed, within fourteen (14) days following notification of the withdrawal decision.

12.3 Refund
Once the returned item(s) have been checked, Rue de Verneuil undertakes to refund the Customer as soon as possible, and no later than fourteen (14) calendar days from the date the Customer informed Rue de Verneuil of their decision to withdraw from the Contract (and provided Rue de Verneuil has received the item(s)), the full amount paid for the returned item(s), including delivery fees (noting that, regarding delivery fees, the maximum refund corresponds to the cost of the cheapest delivery method offered by Rue de Verneuil).

The refund will be made to the bank account or payment account used for the payment of the item(s) in the order, provided that the refund will be suspended until Rue de Verneuil has received the returned item(s). In the absence of receipt of the returned item(s) or proof of shipment within this period, Rue de Verneuil reserves the right to postpone the refund until the returned item(s) are recovered or proof of shipment is provided by the Customer. If the Customer considers that a delivered item is defective, does not match its description, or is incomplete, they should immediately contact Customer Service.
